ABSTRACT

This chapter will cover current and historical controversies regarding Black males and courts. While much focus is given to policing with regard to Black males, much is unknown regarding the courts. This chapter will exclusively highlight the courtroom realities that Black males face in regard to treatment from courtroom operators (judges, prosecutors, etc.) to juries, and decision-making processes within the courts. Within this chapter, the author will first define racial disparity; then explore criminal statistics associated with Black males and specifically identify for which crimes they are likely to be arrested and convicted of within society today; and, lastly, address the impact of racial disparity within the criminal justice system as it relates to courtroom operators, juries, and decision-making within each subsequent stage.
