ABSTRACT

India is a democratic nation, and this is evident from the fact that the media in the country gets to enjoy a considerable freedom related to the publishing of news or broadcasting. Media, in reality, has turned out to be the fourth pillar in the bureaucratic set-up, backed by Article 19 of the Indian Constitution embracing the freedom of press. The freedom provided under the constitution ensures that media houses are free from unnecessary censorship but they are not absolute. The restriction on this freedom can be imposed if it comes under the purview of Article 19(2). Further, the media industry was not granted protection from the otherwise general rules applicable to industries, such as taxation and paid holidays rules.
