ABSTRACT

The wild law philosophy promotes the belief that many problems within human society stem from the anthropocentric view of human beings at the centre of existence, with a corresponding lack of emphasis on the importance of a flourishing environment. The case concerned an environmental challenge to two planned coal mines in Queensland's Bowen Basin - the Bowen Coal 'Isaac Plains Project' and the QCoal 'Sonoma Project'. The challenge was led by the Proserpine/Whitsunday Branch of the Wildlife Preservation Society of Queensland, and supported by the Environmental Defenders Office Queensland. They submitted that the proposed mines be assessed under the Environmental Protection and Biodiversity Conservation (EPBC) Act. Wild laws are laws that capture the importance of preserving the natural environment for the benefit of all Earth's ecosystems and natural entities. The Commonwealth EPBC Act was enacted to implement the provisions of the Convention on Biological Diversity 1992 and other international environmental agreements into Australian law.
