ABSTRACT

This chapter sets out the drafting assumptions, underpinnings and, most importantly, the history of Peninsula principles. It discusses the ways in which the principles were drafted, the methods employed, and the documents which served as the basis for many of the provisions. From 16 to 18 August 2013 on the Mornington Peninsula in Victoria, Australia, an expert group comprised UN officials, judges, international lawyers, jurists, academics, non-governmental organisation (NGO) leaders, researchers, practitioners, consultants and activists met to consider an advanced draft of the Peninsula principles on climate displacement within States. The first draft of the Peninsula principles was produced on 5 May 2013. At the Mornington Peninsula meeting, an extraordinarily rich and intense discussion, analysis and debate took place on the entire meeting draft. Every word, every line, every paragraph was scrutinised by the expert group and a series of fascinating exchanges took place that led ultimately to the final text of the Peninsula principles.
