ABSTRACT

Like politics, all real estate is local. And in no area of real estate law is that axiom more relevant than with local land use and zoning regulation, sometimes referred to herein, and elsewhere in this textbook, collectively as “Land Use Controls.” Land Use Controls, however, as important as they are to the ultimate outcomes of The Development Process, represent only one aspect of a Project’s and its Developer’s near-term and long-term relationship with the local government of the jurisdiction in which that Developer’s Project is located.
