THIRD PARTIES (RIGHTS AGAINST INSURERS) ACT 1930 32.52 Where an insured becomes bankrupt or goes into liquidation either before or after incurring an insured liability to a third party, section 1(1) of the Third Parties (Rights Against Insurers) Act 1930 provides that the insured’s right to indemnity be transferred to the third party. Such third party may therefore claim directly against the insurer, which is required to satisfy that liability to the extent that it is within the terms of the insurance contract.
