ABSTRACT

The manifestations of restorative justice in Chile have focused almost exclusively on penal mediation. This practice differs from conferencing and circles which include the participation of family and other members of the community, and are common in countries such as Canada, New Zealand, England and the United States of America (USA). Reparative agreements constitute the formal legal institution by which penal mediation finds a more adequate place in Chile. In Chile, penal mediation pilots have been implemented since 1998, linked to universities, the public prosecution office, and the SEMANE and legal aid services. Positive psychology raises a number of foundations on which the therapeutic work is based from this clinical model, demonstrating a significant relationship with the approaches of restorative justice restorative justice and penal mediation. The chapter presents brief introduction about the rise and current status of positive psychology, as a recent field within the discipline of human behaviour.
