ABSTRACT

This chapter aims at identifying the necessary conditions for the more effective implementation of laws, thus reducing the gap between the laws in the books and the laws in action. We understand the “chicken or egg” question in this context, assuming an interest in whether law can be used as a means of social engineering, capturing the essence of “on the books” versus “in action.” A case study and jurimetrics-based analysis of impact indicators of judicial reforms are presented below detailing the factors enhancing effective legal implementation within the counter-organized crime judicial domain.
