ABSTRACT

This chapter presents a creative solution over sovereignty can continue to be studied, and many rich examples of the possible 'solution protocols': co-habitation on a divided island, a condominium with a periodic alternating governance, a territory for commercial activity open to treaty signatories, a shared jurisdiction, a divided jurisdiction and so on. It is interesting to see the issue in comparison with the peacebuilding or conflict resolution measures of a divided society. The peaceful resolution of conflict is a foundational principle enshrined in the United Nations Charter. The government declared that it 'will continue to abide by international law and basic norms governing international relations as enshrined in the Charter of the United Nations, including the principles respecting state sovereignty and territorial integrity and peaceful settlement of disputes'. International arbitration is certainly a means of conflict resolution under international law.
