ABSTRACT

It is well known that China is facing high levels of pollution, although scholars have only recently turned their attention to the impact of environmental pollution on health. Whoever had the chance to interview a few Chinese university professors, government representatives, and NGO activists on the issue of the compensation of damages caused by environmental pollution, could easily infer that the problem is at the same time pressing and ignored. 1 What is also stricking is the contrast between the comprehensive Chinese legislation on the compensation for tortious damages and the poor litigation records on the compensation for damages caused by exposure to dangerous substances.
