ABSTRACT

This chapter overviews the policy and legal framework of the phenomenon of ageing and the labour market in Botswana, and where there are gaps to posit some recommendations. It provides pertinent statistics on the number of people aged 65 years and above by age group and sex, current economic activity and sex and occupation and sex and deals with policy and legal frameworks. At independence in 1966 Botswana inherited a combination of both Roman Dutch law and English common law Roman Dutch law treated customary international law no differently from the way English common law treated it. The right to dignity is riot expressly provided for in the Constitution of Botswana. The court placed reliance on international legal instruments as the Organization of African Unity's Convention on non-discrimination and pointed out that Botswana as a signatory to that convention is bound by its terms, notwithstanding that the said convention had not been incorporated into national law.
