ABSTRACT

There has been an unfortunate tendency to remove human rights considerations from situations of war, perhaps because there are two distinct legal regimes: international human rights law, on the one hand, and humanitarian law, or the laws of war, on the other. However, human rights principles continue to operate even in times of conflict. Thus, those who engage in fighting must attempt to kill the enemy while at the same time seek to ensure that they protect the lives and well-being of civilian populations.
