ABSTRACT

This chapter examines the adaptability of the constitutional order of Kazakhstan to the operation of the Eurasian Economic Union. The constitutional order of Kazakhstan fully reflects the vision of the major architect of the country's state-building process, its first President Nursultan Nazarbayev, on how to address numerous acute challenges and problems faced by the newly established state. The country's dynamic foreign policy and, in particular, active participation in the regional integration processes in Eurasia necessarily raise a number of issues related to the status of international treaties, judicial review and application of international treaties in the Republic of Kazakhstan. The institutional framework of the Eurasian Economic Union and the Collective Security Treaty Organisation reflects the constitutional structures of their Member States, which are all republics with strong presidential authorities. The Eurasian Economic Commission may adopt binding and directly applicable decisions.
