At this point, it might be objected that it is (2), rather than the Fairness of Sanctions Thesis, that is the problematic premise. Perhaps it would be unfair to have such a system of sanctions as described earlier, a system that parallels that of the kinds of differential consequences we accept as options luck in the case of gambling or other forms of choice under uncertainty, for example.
