ABSTRACT

Scandals exposed by the media often reveal the reality and make people aware of hidden social issues. However, although violation of human rights in residential care has been exposed over several decades in Japan, they have not led to strong regulations. This chapter will begin by presenting the background on the Japanese ageing society in general and formal residential care services for older people in particular. Next, the existing legal systems for protecting the human rights of older people in residential care will be described. The third section will provide information on the legal and regulatory framework. The fourth section will summarize problems in the Japanese systems and discuss the reasons why they have not been resolved. Finally, it would conclude with recommendations for other countries and for Japan.
