ABSTRACT

14.1 This chapter focuses on those areas where South African law has developed differently from English law, 2 and avoids dealing with general insurance principles that are not relevant to marine cargo 3 insurance. The chapter relies heavily on four main fairly readily available sources, namely, the current marine insurance section in the insurance chapter in volume 12 of The Law of South Africa 4 ; the textbook developed from the LAWSA chapter entitled General Principles of Insurance Law 5 ; the marine insurance chapter in Gordon & Getz 6 ; and the marine insurance chapters in Professor John Hare's book, Shipping Law and Admiralty Jurisdiction in South Africa. 7
