ABSTRACT

This chapter explores the philosophical and legal issues that surround the creating of rights and obligations in respect of future generations; the obligation of society to protect the well-being of future generations and current moves in the UK to embed such a responsibility in statute. It explores the nature of these issues and current legislation/statutes that are being put in place to create a plausible and extendable model for safeguarding the well-being of future generations. Specifically, it considers the recent action of the Welsh Government regarding the “Well-being of Futures Generations Act 2015” which enshrines, in law, a duty on public bodies to safeguard the interests of future generations. As such, the chapter addresses well-being in a legal context and activities to move it to a mainstream enforceable requirement.
