ABSTRACT

This chapter summarizes the key provisions for special education administrators related to state monitoring and enforcement. It examines the statutory foundations of federal and state monitoring and enforcement and describe its evolution from a system based almost entirely on procedural compliance to a system based on outcomes for children with disabilities. The system of federal and state monitoring and enforcement of special education programs and services is rooted in Public Law. Following the passage of Education for All Handicapped Children’s Act and later reauthorized versions, federal monitoring of states consisted primarily of cyclical on-site visits by US Department of Education, Office of Special Education Programs to each state. In preparing for the reauthorization of Individuals with Disabilities Education Act, President George Bush, in October 2001, created the President’s Commission on Excellence in Special Education.
