ABSTRACT

An adequate response to aggression will be required on the part of everybody concerned —the International Criminal Court (ICC), the Security Council, the General Assembly. The way of approaching subject matter would be to indulge in an exercise of crystal-gazing, by trying to ascertain how the ICC might in fact operate regarding the crime of aggression, on the assumption that it would have been endowed with the jurisdiction to deal with that crime, pursuant to Article 5.2 of the Rome Statute. The world could hardly find its way to durable justice and peace with such an abdication of responsibility on the part of those who have to exercise power and leadership.
