ABSTRACT

This chapter describes the social structure of a probation institution and try to find data which can help us understand the observed differences in recidivism rates between those who were sentenced to probation with institutional treatment and those who were not. It determines how the legislator's intentions concerning individual prevention are put into practice. The legislative text provides that institutional treatment shall be included in an of fender's probation if it is "considered necessary for his correction or otherwise". Institutional treatment aims at making probation a more effective sanction than it would otherwise be and probation as such may not be resorted to except when justified by considerations of individual prevention". The rules of an institution are interesting because of the norm system they reflect and because they reveal a great deal about the activities which are normally governed by the rule system.
