ABSTRACT

This chapter examines the contribution of the European Union (EU) Court of Justice – affecting both the European and the national level – in addressing the challenges and the consequences of the global financial and economic crisis. It examines the nature of EU judicial power and the related question of whether the EU Court of Justice can be expected to engage with the pressures and the dilemmas that may arise from the socio-economic context of its operation. The chapter analyses the engagement of the EU Court of Justice, within the jurisdiction available to it and in the context of the cases brought before it. The current financial and economic crisis put significant pressure on and confronted with heavy dilemmas the European economic system and the European and national regimes of socio-economic governance. The engagement of the Court of Justice with crisis-related developments in the Member States in some respects resembles that experienced in connection with European crisis management measures.
