ABSTRACT

This chapter gives an overview of some of the most important cases which hopefully will shed some light on how exactly the Constitutional Court of the Republic of Croatia has acted when faced with situations of crisis. The chapter describes some constitutional experiences related to the, so far, only full-blown 'war' crisis which in Croatia occurred in the first part of the 1990s. It explains further developments in the context of new security challenges that have appeared in recent years. There have been two quite notable exceptions to this, which shed significant light on the Court's stance: the Law on Public Assemblies and the Law on Criminal Procedure. The chapter also reviews some (Financial crisis and economic policy of the state) of the major decisions of the Court concerning legislation enacted, or intended to be enacted, in the context of the last global economic crisis.
