ABSTRACT

The law in Estonia provides that foreign judgments are recognised and enforced according to any treaties concluded between Estonia and a foreign country or according to any conventions to which Estonia has acceded. At present, the issue of enforcement and recognition of foreign judgments is regulated by a number of different provisions contained in various laws and international instruments to which Estonia is a party. These include: the Civil Procedure Code and Enforcement Code; treaties signed between Estonia and foreign countries; and the New York Convention of 1958 on Recognition and Enforcement of Foreign Arbitral Awards. The Estonian Civil Procedure Code provides that a judgment of a foreign court or arbitral court will be enforced according to the treaties signed by Estonia. Estonian law requires that all legislative texts adopted by Estonian Parliament be published in the 'Riigi Teataja', which is the official journal maintained and published by 'Riigikogu'. Estonia has not yet acceded to either Brussels or Lugano Conventions.
