ABSTRACT

There are two principal methods of enforcing a foreign judgment in the Isle of Man: the Judgments Act 1968 and common law rules. A judgment may not be registered where at the date of the application it has been wholly satisfied or could not be enforced by execution in the original country. The procedure for registration of a foreign judgment is contained in Order 34A of the Rules of the High Court of Justice of the Isle of Man 1952. When the judgment is registered, interest on the full amount can be charged in accordance with judgment, or where no provision is made there, at the current rate of 8". A default summons is issued in the High Court of Justice of the Isle of Man. Once issued, the plaintiff will send the summons and acknowledgement of service forms for service by the Coroner on the defendant.
