ABSTRACT

The Indian Constitution under the caption of "fundamental rights" has specifically recognised many rights which have been provided in the Covenant. There are a number of other rights, which have been provided in the Covenant on Civil and Political Rights but have not been specifically laid down in Part III of the Constitution. The compulsion of security must be so pressing that no alternative will work except handcuffs. There must be material sufficiently stringent to satisfy a reasonable mind that there is clear and present danger of escape of the prisoner who is being transported by breaking out of police control and further that by adding to the escort or other strategy, he cannot be kept under control. Women who generally work in the offices have to face problems against sexual harassments by their bosses and colleagues. Right to life and personal liberty guaranteed under article 21 is not limited to citizens only but also to non-citizens.
