ABSTRACT

The geographical focus of the dispute has been on the West Bank and Gaza, territories conquered by Israel in 1967. This chapter evaluates the status of human rights in these territories. It deals not only with Israel’s human rights record in the quarter century between 1967-1992, but also dwells on human rights under the Oslo Accord with the period of transition from occupation to the final status of the territories in questions. Politics and law in the territories have always been intimately interwoven, a reality of immediate relevance for the conditions of human rights. Of particular interest is the political status of the territories, status which has determined the legal framework under which they have ruled, governed and administered. The chapter also deals with some of the most severe enforcement actions. It concludes with a view into the future of human rights in the West Bank and Gaza.
