ABSTRACT

This chapter considers the problems facing member states when they come to implement Community environment legislation. In recent years greater attention has focused on this aspect of the European Community (EC) environmental policy process. The chapter also considers respectively the state of implementation in the member states and those characteristics of the Community legislative process which have an impact on implementation. It assesses Community enforcement mechanisms and the means through which implementation may be improved and outlines the development of the alternative 'inspection of inspectors' concept. The chapter examines why the implementation of EC environment legislation has taken on greater importance in recent years. It shows the reasons for inadequate implementation, where this occurs, of EC environment legislation by member states. The chapter then assesses possible mechanisms to improve the implementation of EC environment legislation and sets out the state of implementation in the member states.
