ABSTRACT

Under the Criminal Procedure and Investigations Act 1996, the defence have a duty to give the prosecution a written statement of the nature of the defence case and to set out the matters upon which the defence take issue with the prosecution. In particular, the defence must give full particulars of any alibi which is going to be raised at trial. Failure to comply with these requirements enables adverse inferences to be drawn by the jury.
