ABSTRACT

Section 87 of the Powers of Criminal Courts (Sentencing) Act 2000 provides that, if an offender has spent time in custody awaiting trial and/or sentence, the length of time spent in custody counts towards the service of a custodial sentence passed in respect of that offence. This means that where an offender has been remanded in custody before conviction and/or sentence, the period for which he has already been detained is deducted from the sentence he has to serve.
