ABSTRACT
If the person who has been bound over fails to keep the peace and to be of good behaviour, the court may order the payment of some or all of the amount of the recognizance.
When the court orders forfeiture of the recognizance it must fix a term of imprisonment (or detention in a young offender institution) to be served in default of payment (s 31 of the Powers of Criminal Courts Act 1973).
