ABSTRACT

The summons is then served, usually by the court posting it to the defendant’s last known address (that is, the address he gave to the police). If this is ineffective (for example, it is returned undelivered by the Post Office), the summons may be served by personal delivery (a police officer will hand the summons to the defendant) or even by leaving it with someone at the defendant’s last known address (r 99(1) of the Magistrates’ Courts Rules 1981).
