ABSTRACT
This is the process by which evidence is collected and a charge is made against an accused. This has been found seriously wanting and, given our accusatorial system, the trial process cannot be any better than the evidence which is brought before the court. If this has been fabricated or obtained as a result of duress, whether physical or psychological, a conviction secured on the basis of such evidence may, many years after the trial, be found to be wrong.
