ABSTRACT
At the court’s discretion, the loser may be ordered to pay a reasonable amount towards the costs of the winner. Usually this amounts to two contributions by the loser, but any shortfall has to be met by the winner by way of statutory charge. Any shortfall of the loser’s costs is paid by the Legal Aid Board. The statutory charge cannot be waived, and only in exceptional circumstances can it be postponed.
