ABSTRACT

Protection (Consolidation) Act 1978 provisions have now been amended, in the Employment Rights Act 1996, expressly to give coverage to safety representatives, and to some extent other employees, (either those with special safety responsibilities, or employees who have no safety representative or no available representative) against dismissal and discrimination short of dismissal for matters related to safety. These provisions specifically cover an employee who leaves what is, or he reasonably believes to be, an unsafe workplace.
