ABSTRACT
The issue of representation arose in Bushell v Secretary of State for the Environment [1981] AC 75 regarding an inquiry into building an extension to the M40. The House of Lords emphasised that inquiries were to be regarded as quite different from courts of law – they were to be governed by a need to conduct themselves in such a way as to guarantee fairness to those who would be affected by any decision which followed from the proceedings.
