ABSTRACT
A person is guilty of an offence if they ‘cause or knowingly permit any poisonous, noxious or polluting60 matter or any solid waste matter to enter any controlled waters’.61 Controlled water is defined in s 104 as:
(a) relevant territorial waters; (b) coastal waters; (c) inland waters; (d) groundwaters.
