ABSTRACT

The Environmental Protection (Applications, Appeals and Registers) Regulations 1991 (SI 1991/507) establish a detailed procedure for applications for IPC authorisations. The application should point out clearly any information that the applicant wishes to be withheld from public registers on the grounds of national security or commercial confidentiality. Section 22 of the Act allows information to be excluded on the grounds of commercial confidentiality. There are also consultation procedures with statutory consultees, who are notified within 14 days of the application and have 28 days in which to respond, unless the application contains information that may be commercially confidential or a risk to national security, in which case the time runs from when these issues are finally determined. The public also has the right to be consulted and the application must be published in a local newspaper.
