ABSTRACT
Monty and Vera Patriot manufacture a range of moisturising creams and lotions. They wish to register four trade marks under the TMA 1994 as follows:
• ‘Pure Cream’; • ‘PUAR CREEM’ Trade Mark; • a Sovereign Trade Mark with a Union Jack on it. On the
register, there is already a similar mark registered by Sovereign Trampoline manufacturers;
• a trade mark consisting of a Belgian flag and Brussel sprout. Monty says that it is a joke aimed at his Belgian friends in the trade, but he does use it on business paper occasionally. Advise Monty and Vera as to bars to the registration of the marks.
