ABSTRACT
This question is based upon the unreported decision in Thorn EMI Films v Arista Records (1983), in which film makers sought to bring an action to restrain the passing off of a record advertised with imagery derived from the plaintiff’s film The Elephant Man. Vice Chancellor Megarry held that damage had to be established, which the plaintiff failed to do.
