ABSTRACT
If a party starts proceedings which for any reason he does not wish to continue with, he has the right to discontinue those proceedings, but he should comply with the procedure for discontinuance under Part 38. There is no similar provision for a defendant to discontinue a defence – he should make an admission on which a judgment can be entered.
