Action on behalf of the estate

If the person injured dies before the time limit for bringing a personal injuries action expires, the time limit within which an action must be brought on behalf of his estate under s 1 of the Law Reform (Miscellaneous Provisions) Act 1934 is three years from either: • the date of death; or • the date of the personal representative’s knowledge,16 whichever is later

(s 11(5)).
