ABSTRACT
A new claim in existing proceedings is a claim by way of set off or counterclaim and any claim involving the addition of a new cause of action or the addition or substitution of a new party (s 35(2). Section 35 specifies when such new claims are deemed to be commenced for the purposes of the limitation period.
