ABSTRACT
There are some circumstances when the court may give permission for a claim form to be issued under Part 8 without naming a defendant. Those circumstances will be prescribed in a practice direction. An application for permission should be made by application notice, under Part 23, before the claim form is issued. The application need not be served on any other person and must be accompanied by a copy of the claim form the applicant proposes to issue. If the court gives permission, it will give directions for the future management of the claim (r 8.2A).
