ABSTRACT
Although it is a key feature of a fast track trial that it will last no longer than one day, the mere possibility that a trial may last longer than one day is not a conclusive reason for the court to allocate a case to the multi-track instead (PD 26, para 9.1(3)(c)). However, where it is clear that the case will last longer than a day the fast track will not be appropriate because of the limits on advocates’ fees and the provision that the part-heard case will normally be heard the next day.40
