CONSISTENCY AND FAIRNESS IN SENTENCING – THE SPLENDOUR OF FIXED PENALTIES

This chapter takes us back to the start of the book. At the outset, it was noted that there is a need to curtail judicial sentencing discretion to make the sentencing process fairer and more consistent. In light of the discussion regarding why we should punish, I consider whether fixed penalties are the way forward.
