Lord Simonds:… My Lords, it was urged by counsel for the appellant that a decision against her when the plaintiff in the Rainham case succeeded would show a strange lack of symmetry in the law. There is some force in the observation. But your Lordships will not fail to observe that such a decision is in harmony with the development of a strictly analogous branch of the law, the law of nuisance, in which also negligence is not a necessary ingredient in the case… To confine the rule in Rylands v Fletcher…appears to me consistent and logical.
