The proposition of the rule of reason

The previous analysis indicates that the rule of reason has been reduced to the simple proposition that once products have lawfully been produced and marketed in one Member State, their importation and sale in another Member State cannot be prevented without contravening Article 30 of the EC Treaty. The court in Schutzverband Gegen Unwesen ID Wirtschaft v Weinvertriebs GmbH102 also decided that goods not manufactured in accordance with the rules of the country of origin but in accordance with those of the country of destination are equally entitled to free movement throughout the European Community.
