ABSTRACT

Entering into a contract is regulated by the Act on Contracts. An offer is made. This offer is binding for a certain period of time, starting from the time when the addressee becomes aware of the offer. Upon receipt by the offeror of an acceptance from a customer, an agreement is entered into. For common law readers it should be noted that Danish law does not apply the concept of consideration. As stated above, an offer is binding, and the binding effect is also attributed to a promise to donate a gift conveyed to the donee. Such a promise is binding, valid, and enforceable.It is legal to stipulate that an offer is not binding but can be withdrawn at any time, or that the offer is only valid for as long as the merchandise is in stock.
