Whether copyright subsists in a work or other subject matter will depend, first, on whether the author,59 maker,60 or publisher61 (as the case may be) was a qualified person62 within the meaning of the 1963 Act as amended, secondly, in relation to published works, the place of publication, and thirdly, on whether the work or other subject matter was original.
