ABSTRACT

Other matters which need to be dealt with at the preliminary hearing include whether or not the parties want a transcript or recording made of the hearing, and whether evidence will be taken under oath. The presumption is that it will be so. It is helpful to an arbitrator to have prior knowledge of any unusual religions as he may need to have particular ‘Holy Books’ such as the Adi Granth, Bhagavad Gita or Koran, which he may not usually carry. Even if he does not have an appropriate book the witness can affirm.
